College Policy Number/Title:
Under Howard County's self-insurance Risk Management Program, in accordance with Section 23.100 of the Howard County Code, Maryland state law, and all other applicable laws, Howard Community College (HCC) employees are covered against risks involved in the performance of their job responsibilities. In the event of a lawsuit, Howard County Government will provide the employee's defense and pay for any judgment from such suit. Employees are covered only for activities included in the scope of their employment, as long as they are acting within the authority and duties as an employee of the college.
Employees are not covered for claims resulting from malicious wrongdoing, criminal activity or from actions falling outside of the scope of authority or employment.
Participation by HCC in the risk management program shall not constitute a waiver of its sovereign immunity or any other immunity available to it or its officers, agents, or employees. The defense of sovereign immunity or other applicable immunities shall be fully available to the college, its board of trustees, the officers, agents, and employees of the college to the extent provided by law. Immunity defenses shall be raised where available.
The County shall coordinate the provision of defense for the college and its employees except with respect to legal advice or defense pertaining to the college’s personnel matters, upon which the college shall employ outside counsel for related legal services.
